Definitions:
- SERVICE – Faturate / faturate.com / app.faturate.com / Faturate on the App Store / Faturate on Google Play
- USER – Any individual or legal entity that subscribes to or uses the SERVICE
User Data:
- The Faturate team, as the creator and provider of the SERVICE, ensures that the USER’s personal data is collected for the purposes of customer management, billing, marketing of products and services, customer communication, advertising, and statistical analysis.
- By subscribing to the SERVICE, the USER acknowledges and agrees to provide the necessary personal data required for its operation. These data will be used exclusively for the purposes mentioned above.
- Under no circumstances will the USER’s personal data be disclosed or shared with third parties without explicit consent, except in the cases outlined below.
- The Faturate team will provide the USER’s account data to the relevant authorities if required by law or in response to a legal notice or court order. Additionally, the Faturate team may share data with third parties in cases of non-compliance with the terms and conditions of the SERVICE, in the context of civil, regulatory, or criminal liability proceedings.
- At any time, the USER may exercise their rights of access, rectification, deletion, restriction, and/or data portability by submitting a written request, accompanied by proof of identity and/or details of the data to be rectified (if applicable), to: info@faturate.com.
- If the USER objects to the processing of their data after the SERVICE has already commenced, this objection will only take effect from the date of sharing such objection with the Faturate team and will not affect the legitimacy of the processing carried out up to that point. Such an objection may result in the inability to continue providing the SERVICE.
- Regarding the right to data portability, please note that this applies only to data collected based on the USER’s consent, as per applicable legislation.
Data Provided by the USER in Faturate:
- As the data controller for the information entered into the software while using the SERVICE, the USER explicitly declares and guarantees that:
- The processing of such data complies with all legal requirements;
- They will provide the necessary instructions to the Faturate team regarding data processing;
- Only the minimum required personal data will be shared for the contracted services;
- They adopt the necessary technical and organizational measures to ensure data accuracy and updates;
- They implement appropriate technical and organizational measures to ensure the confidentiality and security of the data, preventing accidental or unlawful destruction, alteration, loss, unauthorized access, or any other form of unlawful processing, in compliance with applicable data categories.
- As the SERVICE provider and data processor, the Faturate team guarantees that:
- Data processing will only be carried out according to the USER’s instructions, strictly for the purposes for which the data was collected and in compliance with contractual obligations;
- Adequate technical and organizational measures will be implemented to safeguard the confidentiality and security of the data;
- A record of data processing activities will be maintained, including the names and contact details of the USER, any subcontractors, and, if applicable, the Data Protection Officer;
- Access to USER-provided personal data will be restricted to personnel who require it for service provision;
- Personnel with access to personal data will be bound by confidentiality obligations and prohibited from using the data for personal or third-party benefit;
- Data processing will take place exclusively in the USA or the European Union;
- The necessary information will be made available to demonstrate compliance with data protection obligations.
- The Faturate team commits to not sharing personal data with third parties, except where necessary to ensure system security (both hardware and software), and only with third parties that have signed an agreement ensuring compliance with data protection obligations.
- The USER should be aware that the Faturate team works with service providers based in the United States, meaning that data entered into the SERVICE may be processed in that country. When engaging these providers for data processing on behalf of the USER, the Faturate team imposes the same data protection obligations outlined in this privacy policy, ensuring sufficient guarantees for the implementation of appropriate technical and organizational measures in line with GDPR requirements.
- Should the Faturate team wish to subcontract third parties or change existing subcontractors, the USER will be informed. This information will include the identity of the third party, the data to be shared, and the security measures in place.
- The Faturate team commits to notifying the USER without undue delay in the event of a data breach. This notification will include all relevant documentation to enable the USER to inform the competent supervisory authority if necessary. The USER is responsible for notifying the relevant authority in the event of a security breach.
- The Faturate team maintains strict confidentiality regarding any personal data processed while providing the SERVICE and will not disclose, publish, or share such data with third parties without prior written consent from the USER.
- The USER must also respect the confidentiality of the methods and procedures used by the Faturate team to deliver the SERVICE. This obligation does not apply to publicly available information.
- Upon termination of the SERVICE, the Faturate team commits to either returning or securely deleting all personal data held, unless the retention of minimal essential data is required to fulfill legal obligations.
The Faturate team reserves the right to amend this privacy policy at any time, providing at least 24 hours’ notice to the USER. Continued use of the SERVICE after this period will be considered acceptance of the changes.
This policy ensures that the USER can use the SERVICE securely and efficiently.
